Infringement of MenaITech HRMS Leads to Intellectual Property Lawsuit

Amman Court of First Instance Confiscates Illegal and Pirated Software from Builders Solutions

North of Amman Courthouse Judge Hisham Awad Salem Al Tarawneh released a court order last month to confiscate the illegal software from Builders Solutions due to the company’s violation of the intellectual property (IP) rights of the Middle East & North Africa Internet Technologies Human Resources Management System (MenaITech HRMS).

MenaITech lawyer Mr. Mohammad Khaled Rababa’a said, “According to paragraph A in Article 46 of the Copyright Law, the Court of First Instance has been given the authority to ‘confiscate the work, its reproductions, copies and any other materials used in the reproduction’ of the HRMS from both Builders Solutions and Human CP companies.”

He added, “Upon Jordan’s accession to the World Trade Organization and its affiliation with a number of international trade agreements including the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement, the Hashemite Kingdom of Jordan has paid specific attention to IP rights by enforcing a number of laws and legislations to counter piracy and protect IP rights stating that ‘Employees of the National Library Department who are delegated by the Minister shall be considered members of the Judicial Police’.”

It is worthwhile mentioning that Jordan is a member of the World Intellectual Property Organization (WIPO) which has been holding IP agreements since 1985. Moreover, Jordan has a high ranking amongst Arab and worldwide countries regarding IP law enforcement by hosting courts and judges specialized in IP violation cases.
